| چکیده | ||
| فقه سیاسی به‌مثابۀ گرایشی بینارشته‌ای در عرصۀ فقه که مسائل و موضوعات سپهر سیاست را مورد عنایت قرار می‌دهد، گرچه در همۀ اعصار فقهی وجود داشته‌است، ولی تحقق نظام اسلامی با محوریت فقه بر ضرورت آن تأکید کرده‌است. این گرایش در عصر حاضر رویکردی حکومتی برای ادارۀ شریعت‌مدار و مطلوب و کارآمد جامعه به خود گرفته‌است و اهدافی چون ادارۀ زندگی، دین و دنیای مردم و نیز پاسخگویی به نیازهای همه‌جانبۀ زندگی فردی، اجتماعی و حکومتی مؤمنان و شهروندان جامعه اسلامی را برعهده دارد. این گرایش بینارشته‌ای در عرصۀ سیاست، باوجود اشتراکی که با سایر گرایش‌های علوم سیاسی مانند فلسفۀ سیاسی، کلام سیاسی و اخلاق سیاسی در برخی موضوعات و مسائل از جهات مختلفی چون روش، غایت و هدف، منابع و مخاطب دارد، نسبت‌به آن‌ها متمایز بوده و کارویژه‌های متفاوتی را نیز برعهده گرفته‌است. با توجه به محتوای گرایش‌های بینارشته‌ای در عرصۀ سیاست، فقه سیاسی را باید در رده‌بندی، در رتبۀ پشتیبانی‌شده نسبت‌به فلسفۀ سیاسی و کلام سیاسی و نیز پشتیبانی‌کننده نسبت‌به اخلاق سیاسی ارزیابی کرد. فقه سیاسی ازحیث روش، تابع علم فقه است و از روش اجتهاد در پردازش و بررسی و ارائۀ احکام بهره می‌گیرد، بنابراین نسبت‌به گرایش‌هایی چون فقه عبادی، ازحیث رویکردِ حداکثری، به عقل و بنای عقلا و ازحیث رویکرد حداقلی، به تعبدیات متمایز می‌شود. گسترۀ فقه سیاسی تابعی از اقتضائات و شرایط زمانه است و از رویکرد فردی در زمان قبض‌ید فقیهان، تا پرداختن به شئون مختلف زندگی اجتماعی و حکومتی و ادارۀ زندگی شهروندان جامعۀ اسلامی درصورت بسط‌ید و اقتدار اجتماعی فقیهان، امتداد می‌یابد. - - - - - - - - - - - - - - - - - - این مقاله برگرفته از طرح پژوهشی مورد حمایت بنیاد ملی علم ایران (صندوق حمایت از پژوهشگران و فناوران) (insf) با شماره 97024962 می باشد. | ||

| Political jurisprudence as an interdisciplinary tendency in the field of jurisprudence that deals with political issues and issues, although it has existed in all periods of jurisprudence, however, the establishment of the Islamic system with a jurisprudential approach has emphasized its necessity and has, in the present era, become a governmental approach to governing the jurisprudence, favorably and efficiently, with goals such as managing the life of the religion and the people of the world and responding to all the needs of life. Individual, social, and governmental responsibility for believers and citizens of Islamic society. this interdisciplinary tendency in the field of politics, despite sharing with other political science trends such as political philosophy, political theology, political ethics in the system of issues and political issues, in various ways such as method, end and purpose, resources and audience, relevance. They are different and have different characteristics. however, given the content of interdisciplinary tendencies in the political arena, political jurisprudence should be evaluated in the ranking of political arena tendencies, with a priori rank over political philosophy and political theology and a posteriori over political ethics. although the method of political jurisprudence is subordinate to the method of jurisprudence and uses the method of ijtihad in analyzing and presenting rulings, it has a more holistic approach to reason and a minimalist approach to worship. obviously, the scope of political jurisprudence was subject to the conditions of the time and in the time of the jurisprudence's power, it was responsible for analyzing the individual issues of the jurists and, in the case of the social authority of the jurisprudents, it was responsible for analyzing the different aspects of social and governmental life and administering the system of governing the lives of Islamic society. | ||
