| در جهان کنونی، موضوع حقوق‌بشر از جمله برجسته‌ترین عناوین مورد علاقه و مطالعه محافل علمی یا مطالبات عمومی است. در خصوص حقوق‌بشر، اگرچه نظام بین‌المللی مشخصی از حیث هنجاری و سازوکارهای نظارتی و اجرایی شکل گرفته‌است اما دولتها و سایر بازیگران بین‌المللی رویکردهای مختلفی را در عرصه ملی و جهانی در این خصوص ارائه می‌کنند. برخی دولتها یا گروهها غالبا مغرب زمین را محور شکل‌گیری و پیشبرد مفاهیم حقوق بشر در جهان کنونی معرفی می‌نمایند. همین مدعا و عملکردهای مرتبط با آن موجب شده تا سایر فرهنگ‌ها و جوامع انگیزه‌های متنوعی برای به چالش کشیدن این مدعا و طرح نظرات خاص خود پیدا کنند. در چنین وضعیتی، ظرفیت‌سنجی رویکرد شرقی به حقوق‌بشر محل تامل برخی محافل علمی یا سیاسی و اجتماعی است. مطالعه حاضر تلاش کرده تا از گذر مورد پژوهی نوع کنش‌و‌واکنش 5 کشور آسیایی در قبال موازین بین‌المللی حوزه حقوق‌بشر زنان و خانواده، این پرسش را مورد واکاوی قرار دهد که آیا می‌توان با شناسایی نوع نگاه و عملکرد جمعی از جوامع شرقی در یک زمینه خاص از مباحث حقوق‌بشر، این احتمال را قوی دانست که موجودیت رویکرد‌شرقی به حقوق‌بشر محرز است و آیا می‌توان از ظرفیت‌های آن برای توسعه عدالت، صلح و همبستگی انسانی در سطح جهان بهره برد. یافته‌های این پژوهش ضمن رد دو نگاه افراطی و تفریطی در این زمینه، بر لزوم مشارکت عادلانه جهانی و همگرایی بین‌المللی در عین حفاظت از تنوع فرهنگی و ویژگی‌ها و هویت شرقی و بهره‌مندی از ظرفیت‌های مشترک مزبور در مواجهه با بی‌عدالتی‌های ملی و بین‌المللی، تاکید می‌ورزد. روش این پژوهش توصیفی تحلیلی و مبتنی بر فرایند استقرایی و تجزیه حقوقی بین‌المللی مستندات معتبر ذیربط است. حاصل این بررسی برخی افق‌گشایی‌ها برای مطالعات جامع‌تر در آینده و ارائه چارچوب‌هایی در جهت تقویت سیاست‌گذاری هوشمندانه و بهره‌مندی از ظرفیت‌های شرقی برای تامین جهانی عادلانه‌تر و منطبق با رعایت حقوق‌انسانی است. | ||

| In today’s world, human rights are among the most prominent topics of interest in academic circles and public demands. While an established international framework of norms, oversight mechanisms, and enforcement systems exists, states and other international actors present varying approaches to human rights at national and global levels. Some states or groups often portray the West as the primary source and driving force behind the development of human rights concepts in the modern world. This claim, and the actions associated with it, have motivated other cultures and societies to challenge this narrative and offer their own unique perspectives. In this situation, evaluating the potential of an Eastern approach to human rights has become a topic of interest in some academic, political, and social circles. This study investigates the actions and reactions of five Asian countries regarding international standards in the domain of women’s and family rights. It seeks to answer whether identifying the collective views and practices of Eastern societies in this specific area can substantiate the existence of an Eastern approach to human rights. Furthermore, it explores whether such an approach can be utilized to promote justice, peace, and human solidarity globally. The findings of this research reject both overly extreme and dismissive views, emphasizing the necessity of equitable global participation and international convergence while safeguarding cultural diversity and the unique identities of Eastern societies. It also highlights the importance of leveraging shared capacities to address injustices at both national and international levels. This research adopts a descriptive-analytical method based on an inductive process and legal analysis of relevant and credible international documents. The results provide opportunities for more comprehensive future studies and frameworks to strengthen policymaking, ultimately leveraging Eastern capacities to achieve a fairer global order that aligns with human rights principles. | ||
