| حقوق بشر به عنوان یکی از مفاهیم بنیادین جهان معاصر، مجموعه‌ای از حقوق و آزادی‌های ذاتی، غیرقابل انتقال و غیرقابل انکار برای تمامی انسان‌ها است که فارغ از جنسیت، مذهب، نژاد، زبان و ملیت، از ویژگی‌هایی همچون غیرقابل نقض بودن، قابلیت قانونمندی، حمایت و تضمین، جهانی بودن و ذاتی بودن برخوردار است. این پژوهش با هدف شناسایی مبانی اخلاقی و عملکردی حقوق بشر در چارچوب رهیافت شرقی، به تحلیل مجموعه‌ای از دیدگاه‌ها، فلسفه‌ها و شیوه‌های اندیشه‌ای شکل‌گرفته در شرق، به ویژه قاره آسیا، می‌پردازد. با استفاده از روش تحلیل موضوعی (تماتیک) به عنوان یکی از روش‌های پرکاربرد در پژوهش‌های کیفی، داده‌های مرتبط با مبانی اخلاقی و عملکردی حقوق بشر در رهیافت شرقی استخراج و الگوهای کلیدی شناسایی شده‌اند. یافته‌های پژوهش نشان می‌دهد که مبانی اخلاقی حقوق بشر در رهیافت شرقی عمدتاً بر فلسفه‌های اخلاقی و دینی مانند فلسفه کنفوسیوسی، فلسفه‌های هندی، بودیسم و حقوق بشر اسلامی استوار است. این مبانی دارای وجوه متمایز و گاه مشترک هستند که در این مقاله به صورت مستدل تحلیل شده‌اند. در عین حال، هر یک از این مبانی در مرحله اجرا و پیاده‌سازی با چالش‌هایی همچون تفاوت‌های فرهنگی، تأثیرپذیری از سیاست‌های حکومتی، بی‌عدالتی‌های اجتماعی و اقتصادی مواجه هستند. تحلیل کاربردی این مبانی مستلزم توجه به اختلافات فرهنگی و تاریخی در گذار از رهیافت شرقی است، به‌گونه‌ای که با درک این تفاوت‌ها، چالش‌های پیش‌رو قابلیت حل‌وفصل داشته باشند. عناصر بنیادین حقوق بشر در رهیافت شرقی نیازمند تجدید نظر در تفسیر و عملکرد است. چراکه برای تحقق بهتر حقوق بشر در چارچوب رهیافت شرقی، تجدید نظر در تفسیر و عملکرد عناصر بنیادین حقوق بشر ضرورتی انکارناپذیر است | ||

| Human rights, as one of the fundamental concepts of the contemporary world, are a set of inherent, non-transferable and inalienable rights and freedoms for all human beings, regardless of gender, religion, race, language and nationality, which have characteristics such as inviolability, legality, protection and guarantee, universality and innateness. This research aims to identify the ethical and functional foundations of human rights within the framework of the Eastern approach, and analyzes a set of perspectives, philosophies and ways of thinking formed in the East, especially the Asian continent. Using thematic analysis as one of the widely used methods in qualitative research, data related to the ethical and functional foundations of human rights in the Eastern approach have been extracted and key patterns have been identified. The research findings show that the ethical foundations of human rights in the Eastern approach are mainly based on ethical and religious philosophies such as Confucian philosophy, Indian philosophies, Buddhism and Islamic human rights. These principles have distinct and sometimes common aspects that have been analyzed in this article in a reasoned manner. At the same time, each of these principles faces challenges in the implementation and execution stage, such as cultural differences, influence from government policies, and social and economic injustices. The practical analysis of these principles requires attention to cultural and historical differences in the transition from the Eastern approach, so that by understanding these differences, the challenges ahead can be resolved. The fundamental elements of human rights in the Eastern Approach require a revision in interpretation and practice. Because for the better realization of human rights within the framework of the Eastern Approach, a revision in the interpretation and practice of the fundamental elements of human rights is an undeniable necessity. | ||
