| Custom is an important phenomenon in Shiite jurisprudence, which since the last century has led to the creation of new terms, including sira and banay-e-aqla. It is noteworthy that the use of custom, especially in the field of politics and political jurisprudence, has been sporadic and often has not received practical and operational attention. Therefore, the question raised in this study is related to the innovations of custom in politics and its structure with a jurisprudential-theoretical approach. In this article, by considering innovative aspects such as reviewing the theoretical framework of jurists and adopting their principles in the political and social events of their time, especially paying attention to the socio-political conditions of the Constitutional period and after, it has extracted cases under the title of customary establishment and innovation in politics. As a result, with a descriptive-analytical method, cases such as: applying the rule of repelling corruption with corrupt in politics by relying on custom, establishing a political system based on general elections and acting on majority votes, not separating religion and politics by emphasizing custom, formulating customary law and institutions (the Shura Council and the executive branch), theoretical attention to enjoining good and forbidding evil and the advice of Muslim imams, theorizing customary council and consultation in political jurisprudence, and expanding the area of religious freedom for the movement of customary reason will be among the most important establishments and innovations of custom in politics and political jurisprudence. | ||
