This study examines the theoretical and practical challenges between modern legal systems and the legal framework of an Islamic state, focusing on the relationship between fiqh and law.In the Islamic state, fiqh serves as the primary source of legislation, whereas modern legal systems derive law from the concept of general will. The core issue is comparing the position of general will in modern law with Imam Khomeini's perspective as the architect of the Islamic Republic of Iran.Research Objectives: 1.To explain the role of general will in modern legal systems and analyze its relationship with jurisprudence-based law.2.To examine Imam Khomeini’s views on the interaction between fiqh and law in an Islamic state. Methodology: A descriptive-analytical approach using library resources. Key Findings:1. In modern legal systems, law reflects the general will, with legitimacy dependent on majority consensus. This view stems from social contract theory, which treats law as a human-made and adaptable construct. 2. In Imam Khomeini’s jurisprudential-legal system, while laws must align with Islamic principles, public participation in legislation remains essential. By integrating Wilāyat al-Faqīh (Guardianship of the Jurist) with "religious democracy, he argued that governmental legitimacy requires popular approval, but legal content must comply with divine rulings. Thus, general will operates within the framework of Sharia, not independently of it.3. Imam Khomeini emphasized dynamic ijtihad (juridical reasoning) and the role of time and place in deriving rulings, demonstrating that fiqh can address evolving societal needs while preserving Islam’s fixed principles. This approach mitigates apparent conflicts between fiqh and modern law. | ||
