| چکیده | ||
| در این نوشتار، با روش تحلیل منطقی اسناد و مدارک علمی تاریخی، رویه آمریکا در تدوین و پذیرش معاهدات بین‌المللی از منظر توجه به حقوق جامعه بین‌المللی در کل و یا صرفاً منافع ملی کشور مذکور، بررسی شده است. یافته‌های این پژوهش حاکی‌از آن است‌که آمریکا، اصولاً پایه‌گذار تدوین معاهدات مؤسس سازمان‌های بین‌المللی و معاهداتی که معمولاً تحت هدایت آن سازمان‍ها ایجاد می-گردند، می‌شود و با سوءاستفاده از ترس اکثر کشورها از جنگ و انزوا، آن‌ها را تحریک و بعضآ تشویق به عضویت در این‌گونه معاهدات می‌کند. سپس، با عدم عضویت یا با عضویت مشروط یا خروج از معاهدات، متعهد بودن دیگر کشورها را به فرصت تبدیل مینماید و از بدون تعهد یا کمتر متعهد بودن خود، به نفع منافع ملی آمریکا که عملاً منافع کل بشریت را در‌بر ندارد، بهره‍برداری می‌کند. به عبارت دیگر، آمریکا، با تشویق دیگر کشورها به خودمحدودسازی ارادی و گسترش هدفمند ضعف‌های عامداً موجود در حقوق بین‍الملل همچون امکان استفاده از تعابیر جایگزین و معیارهای دوگانه وهمچنین معافیت‍گرایی، در ظاهری قانونی، اهداف خود را دنبال و افکار عمومی آزادگان جهان منجمله مردم آزاده کشور خود را مدیریت مینماید. بر این اساس، گریزی وجود ندارد جز آنکه پژوهشگران این حوزه، با آگاهی‍بخشی به دیگران، موجب اتحاد کشورها گردند، به این امید که ترس از انزوا، به آمریکا و دیگر اعضای دائم شورای امنیت منتقل شود تا مجدداّ شاهد تهدید توسط آمریکا بهنگام اعتراض کشورها به خاص‍گرایی‍های موجود، نگردیم. | ||

| Research findings indicate that the United States usually forms the basis for the drafting of treaties establishing international organizations and other treaties that are usually established under the guidance of those international organizations. then, encourages most countries to join international treaties by taking advantage of their fears of war and isolation. The mentioned country then, by not being a member of, or a conditional membership, or withdrawing from international treaties, turns the restrictions of other countries into an opportunity. From its non-commitment or less commitment, it benefits the national interests of the United States, which practically does not include the interests of the entire humanity. In other words, the United States, by encouraging other countries to voluntarily self-limit and purposefully expand the deliberate weaknesses in international law, such as the possibility of using alternative interpretations and double standards, as well as exemptionism, pursues its goals in a legal appearance to manage the public opinion of the world's free people including the free people of its own country. Based on this, there is no escape except that the researchers of this field, by informing others, will bring about the unification of the countries, hoping that the fear of isolation will be transferred to the United States and the permanent members of the Security Council so that we no longer see the threat of a world war by United States when countries protest against the existing particularisms. | ||
