| چکیده | ||
| آرمان اداره جامعه بر مبنای احکام اسلامی، ریشه در اعتقاد به توحید در حاکمیت و جامعیت شریعت دارد. امام خمینی (ره) فقه را تئوری جامعی برای اداره انسان و جامعه معرفی کردند. این پژوهش، با اذعان به این ظرفیت، روشی نوین برای تحقق آن ارائه می‌دهد. تحقیق حاضر لایه‌ای مغفول از فقه را با عنوان «فقه اصول حاکم بر ابواب فقهی» تببین می‌کند که با استخراج اصول، قواعد و نظامات کلان، قادر به ساماندهی ساختارهای اجتماعی است. در این راستا، چیستی و ماهیت فقه اصول حاکم بر ابواب فقهی، روش‌شناسی و نسبت آن با روش‌های رایج دیگر بررسی شده است. برای اثبات وجود این لایه، از دو دسته ادله بهره گرفته شده است: نخست، ادله ثبوتی از قرآن، سنت و عقل که بر جامعیت دین و نقش تبیینی قرآن در ارائۀ چهارچوب‌های کلی تأکید دارند؛ دوم، ادله اثباتی که با تحلیل رویه برخی فقها در ابواب ولایت فقیه، معاملات و اجتهاد و تقلید بهره‌گیری از اصول و قواعد در اجتهاد را دارای سابقه اما نیازمند ضابطه‌مندی و توسعه نشان می‌دهد. یافته‌ها حاکی از آن است که فقه اصول حاکم بر ابواب فقهی، با تکیه بر مبانی معرفتی اسلامی و روش‌شناسی جامع، ظرفیتی بالقوه برای نظام‌سازی اجتماعی دارد و ابزاری مؤثر در تحقق اهداف تمدنی اسلام و اداره جامعه بر پایه شریعت است. | ||

| The aspiration to administer society based on Islamic rulings is rooted in the belief in unity of sovereignty and the comprehensiveness of Sharia. Imam Khomeini introduced jurisprudence as a comprehensive theory for managing both the individual and society. The current research elucidates a neglected layer of jurisprudence, titled “The Jurisprudence of Dominant Principles Over the Chapters of Jurisprudence”. By extracting macro-principles, rules, and systems, this layer is capable of organizing social structures. In this regard, the nature and essence of the Jurisprudence of Dominant Principles, its methodology, and its relation to other common methods are examined. To demonstrate the existence of this layer, two categories of evidence are employed: first, foundational proofs from the Qur’an, Sunnah, and intellect, emphasizing the comprehensiveness of religion and the explanatory role of the Qur’an in providing general frameworks; second, confirmatory proofs that, through analyzing the practice of certain jurists in areas such as wilayat al-faqih, Transactions and ijtihad and taqlid, reveal that the use of principles and rules in ijtihad has precedent, yet requires systematization and further development. The findings indicate that Jurisprudence of Dominant Principles Over the Chapters of Jurisprudence, by relying on Islamic epistemic foundations and a comprehensive methodology, possesses a potential capacity for social systemization and is an effective tool for realizing the civilizational goals of Islam and administering society based on the Sharia. | ||
