| چکیده | ||
| فقه حکومتی–تمدنی بهعنوان مرحلهای پیشرفته از تطور دانش فقه، نیازمند چارچوبی روشمند برای استنباط احکام و طراحی نظامات اجتماعی–تمدنی است. یکی از مؤلفههای بنیادین این چارچوب، «نظاموارگی فقه» است که در سه سطح درونی، استنباطی و بیرونی نمود مییابد و میتواند مبنای روششناسی اجتهاد در قلمرو حکومت و تمدن قرار گیرد. پژوهش حاضر با هدف ارائه «الگوی نظاموارگی فقه در روششناسی فقه حکومتی–تمدنی»، به تبیین و تحلیل دو رویکرد اصلی مؤثر بر این الگو (رویکرد منظومهای و روش انضمامی) میپردازد. رویکرد منظومهای با تأکید بر کلاننگری، انسجام درونی شریعت و پیوند میان آموزههای اعتقادی، اخلاقی و فقهی، امکان تبیین نظامهای کلان دینی و طراحی الگوهای جامع حکومتی و تمدنی را فراهم میکند؛ در حالی که روش انضمامی با تمرکز بر مسائل عینی، مقتضیات زمان و مکان، و پیوند فرآیند تطبیق احکام فقهی با شرایط عینی جامعه، ظرفیت پاسخگویی سریع و مسئلهمحور به نیازهای حکومتی–تمدنی را داراست. این پژوهش با روش توصیفی–تحلیلی و با بهرهگیری از شیوه استنباطی، نشان میدهد که نسبت طولی و مکمل این دو رویکرد میتواند الگوی کارآمدی برای نظاممند کردن فرایند اجتهاد در حوزه حکومت و تمدن ارائه کند؛ الگویی که از یکسو ریشه در انسجام معرفتی و درونی فقه دارد و از سوی دیگر قادر است نظامات اجتماعی، سیاسی، اقتصادی و فرهنگی را در سطح کلان تمدنی طراحی و پشتیبانی نماید. دستاورد این مقاله، تبیین سازوکارهای روششناختی است که بر اساس آن، نظاموارگی فقه میتواند در قالب یک الگوی جامع، مبنای تولید نظامهای حکومتی–تمدنی و پاسخگویی به نیازهای در حال تحول تمدن اسلامی قرار گیرد. | ||

| Governmental–civilizational fiqh, as an advanced stage in the development of Islamic jurisprudence, requires a systematic framework for deriving rulings and designing social–civilizational systems. A fundamental component of this framework is the “systemicity of fiqh,” which appears on three levels—internal, inferential, and external—and can serve as the methodological basis of ijtihad in the domains of governance and civilization. This study aims to present a “model of fiqh systemicity in the methodology of governmental–civilizational fiqh” by examining and analyzing two major approaches that shape this model: the systemic (manzumeh-based) approach and the conjunctive (inzimamī) method. The systemic approach, by emphasizing holistic vision, the internal coherence of the Sharia, and the interconnection of doctrinal, ethical, and legal teachings, enables the discovery of macro-religious systems and the formulation of comprehensive governmental and civilizational models. In contrast, the conjunctive method focuses on concrete issues, the exigencies of time and place, and the integration of fiqh texts with real societal conditions, thus offering the capacity for rapid, problem-oriented responses to governmental–civilizational needs. Using a descriptive–analytical method grounded in inferential reasoning, this research shows that combining these two approaches can provide an effective model for systematizing the ijtihad process in governance and civilization. Such a model, rooted in the epistemic coherence of fiqh while capable of designing and supporting social, political, economic, and cultural systems at a civilizational level, clarifies the methodological mechanisms through which fiqh systemicity can serve as a comprehensive foundation for generating governmental–civilizational systems and addressing the evolving needs of Islamic civilization. | ||
