| This article critically examines Alberto Giubilini and Francesca Minerva's defense of infanticide, presented in their controversial paper "After-Birth Abortion: Why Should the Baby Live?" By distinguishing between 'biological human' and 'moral person,' they argue that newborns, like fetuses, lack the capacities for self-awareness and valuing their own existence, and therefore do not qualify as 'actual persons' with a right to life. Consequently, they contend that the same justifications for abortion apply to infanticide. This view, however, has been widely criticized—even by abortion proponents—for conflicting with human dignity and fundamental equality. The article reveals that Giubilini and Minerva's criterion not only excludes fetuses and newborns but also individuals with severe mental disabilities or those in persistent vegetative states, leading to a problematic ethical functionalism. Their claim that 'harm only makes sense when experienced' is challenged by pointing out that losing the potential for future flourishing is itself a profound harm, even if not consciously experienced. Moreover, their definition implies that painless, sudden killing of adults is also non-harmful—a clear internal contradiction. Ultimately, the article concludes that Giubilini and Minerva's theory is logically inconsistent and undermines core ethical principles. The only coherent alternative is to ground the right to life in inherent human dignity, independent of temporary cognitive capacities. | ||
