| گسترش و پیچیدگی بازارهای مالی سبب ایجاد قراردادهایی گردیده است که تشخیص ماهیت آنها بهمنظور ترتب آثار حقوقی، دشوار باشد. گاهی متعاملین بهمنظور وصول به هدفی معین، مجموعهای از عقود را در قالب یک عقد منعقد کرده و آثار متعدد حقوقی را بر آن مترتب مینمایند. تعهدات ترکیبشده ممکن است به یکدیگر وابسته بوده و یا مستقل باشند. این مقاله ضمن بررسی انواع عقود مرکب و تمییز آنها از موارد مشابه، امکان و موانع ترکیب را مورد بررسی قرار داده است. بررسی انواع ترکیب عقود، ما را به این حقیقت رهنمون میسازد که ماهیت عقد مرکب، بهطور غالب، مبتنی بر نیازهای عرف و رفتارهای اجتماعی است. عرف، ملاک مقبولیت و پذیرش این عقد در جوامع مختلف است. ازاینرو، ماهیت آن در فقه اسلامی از انعطاف بالایی برای تنظیم روابط حقوقی برخوردار است، مشروط بر اینکه ضوابط عمومی قراردادها و معیارهای عرفی رعایت شوند. انعطاف نظام عقود در این تحقیق، با تبیین انواع عقود ترکیبی مورد بررسی قرار گرفته است. یکی از ثمرات مهم انعطاف نظام عقود، تعدیل شروط و وضع قوانین جدید در قراردادهای مرکب است که عدم توجه به این مهم، سبب عدم شناخت دقیق ماهیت این دسته از قراردادها میشود. | ||

| The expansion and complexity of financial markets have led to the creation of contracts whose nature is difficult to determine in order of effect. Sometimes, in order to achieve a specific goal, the parties conclude a group of contracts in the form of a contract and assign multiple legal effects to it. Combined obligations may be dependent on each other or independent. This article, while examining the types of compound contracts and distinguishing them from similar cases, has examined the possibility and obstacles of combination. Examining the types of combination of contracts leads us to the fact that the nature of a compound contract is predominantly based on the needs of custom and social behavior. Custom is the criterion for the acceptability and acceptance of this contract in different societies. Therefore, its nature in Islamic jurisprudence enjoys high flexibility for regulating legal relations, provided that they comply with the general rules of contracts and customary criteria. The flexibility of the contract system has been examined in this study by explaining the types of compound contracts. One of the important results of the flexibility of the contract system is the adjustment of conditions and the establishment of new rules in complex contracts. Failure to pay attention to this issue results in a lack of accurate understanding of the nature of this category of contracts. | ||
