| چکیده | ||

| چکیده [English] | ||
| The fundamental question of this research is to explain the nature of "oughts" and norms—ethical, sharīʿa, and legal—within the framework of the theory of iʿtibārī perceptions (iʿtibāriyāt) in Islamic philosophy. Despite the dominance of "ought" concepts in individual and social life, a coherent and comprehensive explanation of their origin, types, and realm of normativity seems necessary. In confronting extreme relativism, on the one hand, and claims of essential necessity for certain norms, on the other, the approach of Islamic philosophy—distinguishing "is" from "ought" and emphasizing the role of construction (jaʿl) as opposed to discovery (kashf)—can provide new foundations for understanding social "oughts." This article aims to offer a comprehensive analytical framework for understanding iʿtibārī "oughts," distinguishing their ethical, sharīʿa, and legal types, and examining the possibility of stability and permanence in the changing world of iʿtibāriyāt. The research employs an analytical-critical method, relying on authentic sources of Islamic philosophy as well as a critique of relevant theories in moral and legal philosophy. The findings indicate that ethical, sharīʿa, and legal "oughts" all belong to the category of iʿtibāriyāt, and their distinction lies in their "constructor" (muʿtibar), "purpose" (gharad), and "sanction" (ḍamānat-e ijrā). The iʿtibārī nature of these propositions implies their lack of absolute stability; however, based on "universal human needs," the "principle of non-futility" (aṣl-e ʿadam-e lughawiyyat), and the "role of reason and collective wisdom" (ʿaql va kherad-e jamʿī), they enjoy relative stability and can serve as possible foundations for general rules of ethics and law | ||
