| چکیده [English] | ||
| A normative analysis of the legal regime of Antarctica in light of foundational international instruments especially the Antarctic Treaty of 1959 and the 1991 Madrid Protocol, reveals a paradigmatic shift in territorial governance from the traditional concept of “sovereignty based on physical presence” to “algorithmic and intelligent regulation” in response to the challenges of the cybernetic age. The integration of disruptive technologies such as artificial intelligence, blockchain, the Internet of Things, and satellite data has transformed the ontology of surveillance in Antarctica into a dynamic, data-driven structure which, although it has opened new horizons of normative transparency and informational oversight, has simultaneously given rise to conflict-laden situations stemming from platform-based crimes, encroachments upon biological data, carbon-digital pollution, and the manipulation of metadata. Accordingly, the redefinition of the international responsibility of states and developers, proactive oversight of algorithms, assessment of digital risks, and the incorporation of electronic dispute-resolution mechanisms constitute the legislative imperatives of a new legal order in which “platform ecosystem security” is recognized as one of the fundamental interests and a prerequisite for the effective protection of scientific data. | ||
