| هدف این مطالعه تحلیل و تبیین اندیشه آندره نولکمپر در حقوق مسئولیت بین‌المللی با تأکید بر مبانی فلسفی و نظری آن بود. با روش توصیفی‑تحلیلی و رویکرد تفسیری‑انتقادی، آثار بنیادین نولکمپر، پروژه «شیرز» و اصول راهنمای مسئولیت مشترک (۲۰۲۰) را بررسی کرد. یافته‌ها نشان داد که نولکمپر نظام سنتی مسئولیت را از سه جهت نقد می‌کند: محدودیت‌های اصل مسئولیت مستقل در مواجهه با کنش جمعی، ناکارآمدی وحدت‌گرایی و ابهام تمایز قواعد اولیه و ثانویه. در چارچوب مفهومی بدیل، وی مسئولیت مشترک را بر پایه تکثر کنشگران، پیامد زیان‌بار واحد و ناکافی‌بودن سبب‌شناسی فردی تعریف و گونه‌های همکارانه و تجمعی آن را از مسئولیت جمعی تفکیک می‌کند. بنیان‌های فلسفی اندیشه او در سه محور صورت‌بندی می‌شود: نقد وحدت‌گرایی در پرتو رویکرد افتراقی، بازتعریف مسئولیت براساس پیامد به جای فعل متخلفانه و تلفیق وظیفه‌گرایی، پیامدگرایی، تحلیل اقتصادی حقوق و نظریه بازی‌ها. راهکارهای عملی وی، از جمله اصول راهنمای مسئولیت مشترک و آموزه مسئولیت پیشگیرانه، تلاشی برای تبدیل این چارچوب نظری به معیارهای کاربردی است. نتیجه آنکه اندیشه نولکمپر با تغییر زاویه دید از مسئولیت فردی به ساختارهای چندکنشگری، بستری نظری برای بازاندیشی در حوزه‌هایی چون تغییرات اقلیمی، عملیات حفظ صلح و حقوق پناهندگان فراهم می‌آورد؛ هرچند تحقق عملی آن با موانعی چون مقاومت دولت‌ها، ساختار دوجانبه حل‌وفصل اختلافات و دشواری اثبات سبب‌شناسی در موقعیت‌های تجمعی مواجه است. | ||

| This study aimed to analyze Andre Nollkaemper's thought on international responsibility law, focusing on its philosophical and theoretical foundations. Using a descriptive-analytical method with an interpretive-critical approach, it examined Nollkaemper's foundational works, the SHARES project, and the Guiding Principles on Shared Responsibility (2020). Findings show Nollkaemper critiques the traditional responsibility system on three grounds: the limitations of independent responsibility in collective action, the inefficacy of Legal Unitarianism, and the ambiguity of the primary/secondary rules distinction. In his alternative framework, he defines shared responsibility based on actor plurality, a single adverse outcome and the inadequacy of individual causation, distinguishing its cooperative and cumulative forms from collective responsibility. His philosophical foundations rest on three pillars: a differentiated approach rejecting Legal Unitarianism, redefining responsibility by consequence rather than wrongful act and integrating deontology, consequentialism, economic analysis of law and game theory. His practical proposals - including the Guiding Principles and the doctrine of preventive responsibility - aim to translate this framework into operational criteria. Nollkaemper's thought thus shifts focus from individual responsibility to multi-actor structures, offering a theoretical basis for rethinking climate change, peacekeeping and refugee law - though its implementation faces obstacles: state resistance, the bilateral structure of dispute settlement and evidentiary difficulties in cumulative settings. | ||
